Terms of Service

These Terms of Service (“Terms”) govern access to and use of BudFox.ai, including www.budfox.ai, desk notes, chat, blotter, map, MCP tools, and related features (the “Service”). By accessing the Service, requesting a magic link, or clicking Acknowledge & sign in, you agree to these Terms and our Privacy Policy.

If you do not agree, do not use the Service.

1. Who we are

The Service is operated by BudFox.ai (“BudFox,” “we,” “us”). Contact: contact@budfox.ai.

2. Educational use only — not investment advice

BudFox provides informational and educational content only. Nothing on the Service is investment, trading, legal, tax, or accounting advice, and nothing is a recommendation to buy, sell, or hold any security, option, future, crypto asset, or other instrument, or to adopt any strategy.

• BudFox is not a registered investment adviser, broker-dealer, commodity trading advisor, or financial planner.
• No fiduciary, advisory, or brokerage relationship is created by using the Service.
• You are solely responsible for your own decisions. Consult qualified professionals before acting on any information.
• Do not use the Service as a basis for live trading or investment decisions. Markets involve substantial risk of loss, including loss of principal.

3. Artificial intelligence and data limitations

Analysis, desk synthesis, strategy backtests, and “Stock Prediction for Tomorrow” (and similar forward-looking copy) are generated by automated models and quantitative approximations. They can be incomplete, delayed, biased, or wrong.

• Past performance, hit rates, and backtests are not indicative of future results.
• Quotes, options, filings, news, and scan timestamps may be delayed, intermittent, or unavailable.
• PineTS / community strategy results are hypothetical simulations on historical bars, not live TradingView executions and not audited performance.
• Always verify material facts independently before relying on any figure or narrative.

4. Eligibility and accounts

You must be at least 18 years old (or the age of majority where you live) and able to form a binding contract. You agree to provide accurate name and email information. Magic-link sign-in is personal to you; do not share access. We may refuse, suspend, or terminate access at any time.

5. Acceptable use

You agree not to:

• Use the Service for live trading decisions or to solicit others to trade.
• Scrape, overload, reverse engineer, or disrupt the Service beyond ordinary use.
• Misrepresent outputs as human-authored research, guaranteed results, or regulated advice.
• Upload malware, attempt unauthorized access, or interfere with other users.
• Submit secrets, passwords, or personal data of others into chat, or use the Service for unlawful activity.
• Republish paywalled desk material as if it were your own product without permission.

6. Optional brokerage connection

If you connect Alpaca or another integration, you authorize BudFox to use the credentials you provide solely to fetch account data for features you enable (for example a personal blotter). You remain bound by that provider’s terms. We do not guarantee connectivity, order routing, or execution. The Service does not place trades for you unless a feature is explicitly labeled and separately agreed. Paper and live brokerage activity is at your own risk.

7. Intellectual property

BudFox, the fox mark, desk notes, software, and site design are owned by us or our licensors. We grant you a limited, revocable, non-exclusive, non-transferable license to access the Service for your personal, educational use. Market data and third-party content remain subject to those providers’ terms. You retain rights in the text you submit; you grant us a license to process it to operate and improve the Service.

8. Third-party services

The Service depends on third parties (hosting, auth, AI models, market data, news, video embeds). Their availability, accuracy, and policies are outside our control. Links and embeds are provided for convenience; we are not responsible for third-party sites.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUTPUTS ARE ACCURATE, COMPLETE, TIMELY, OR SUITABLE FOR ANY TRADING OR INVESTMENT PURPOSE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUDFOX AND ITS OPERATORS, CONTRIBUTORS, AND PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, TRADING LOSSES, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (US$100) OR THE AMOUNT YOU PAID US FOR THE SERVICE IN THE THREE MONTHS BEFORE THE CLAIM (IF ANY). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE PLACES, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED.

11. Indemnity

You will defend and indemnify BudFox and its operators against claims, damages, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your trading or investment activity, your content, or your violation of these Terms or applicable law.

12. Termination

You may stop using the Service at any time. We may suspend or terminate access immediately if we believe you have violated these Terms or that continued access presents risk. Sections that by nature should survive (including 2, 3, 7, and 9–14) survive termination.

13. Changes

We may modify the Service or these Terms. The “Effective” date above is the current version. Continued use after a change constitutes acceptance. If you do not agree, stop using the Service.

14. General

These Terms are the entire agreement between you and BudFox regarding the Service and supersede prior understandings on that subject. If a provision is unenforceable, the rest remains in effect. You may not assign these Terms without our consent; we may assign them in connection with a reorganization or sale. Failure to enforce a provision is not a waiver.

These Terms are governed by the laws of the United States and the State of Delaware, excluding conflict-of-law rules, except where mandatory local consumer law applies. Courts located in Delaware shall have exclusive jurisdiction, except that we may seek injunctive relief anywhere.
